These Terms and Conditions ("Terms") govern access to and use of the BeatSUD research study mobile application (the "App"). Please read them carefully. The App is provided for participation in an approved research study and is not a general health, treatment, or entertainment service.

1. Who provides the App

The App is provided by BeatSUD Foundation ("BeatSUD," "we," "us," or "our") in connection with the research study identified below.

2. Relationship to informed consent and study materials

These Terms govern use of the App. They do not constitute informed consent to participate in research. Before enrollment, you must complete the separate IRB- or ethics-committee-approved informed-consent process. The informed consent form, study protocol as applicable to participants, and other approved study materials explain the study's purpose, procedures, risks, benefits, alternatives, compensation, contacts, privacy protections, and your rights as a research participant.

If these Terms conflict with the informed consent form or other IRB-approved participant materials on a research-related issue, the IRB-approved materials control. Nothing in these Terms waives any legal right, research-participant protection, or right relating to research injury that cannot lawfully be waived.

 

3. Eligibility and voluntary participation

You may use the App only if you are at least 18 years old, meet the study's eligibility requirements, are located in a country where enrollment has been authorized, and can legally agree to these Terms. Study participation is voluntary. You may decline to participate or withdraw without penalty or loss of benefits to which you are otherwise entitled, as described in the informed consent form.

The study team may determine that you are not eligible or may discontinue your participation for safety, scientific, legal, operational, or protocol-related reasons. Ending study participation may also end access to some or all App functions.

4. Your account and phone-number verification

You must provide accurate information and maintain control of the mobile phone number associated with your account. The phone number is used to create or identify your account and to send one-time passcodes (OTPs) for identity verification and multi-factor authentication. These are transactional security messages, not advertising or marketing messages. Message and data rates may apply, and delivery is not guaranteed in every country or through every carrier.

 

Do not share an OTP or allow another person to use your account. Notify the study team promptly if your phone is lost, your number changes, you suspect unauthorized access, or you receive an OTP you did not request. If you stop or block authentication texts, you may be unable to access the App. The App Privacy Policy provides more information about phone-number processing and SMS providers.

 

5. Permitted use

BeatSUD grants you a limited, personal, revocable, nonexclusive, nontransferable license to install and use the App only for your authorized participation in the study and in accordance with these Terms and study instructions.

You agree not to:

• give another person access to your account or impersonate another participant;

• submit information you know is false, fabricated, or misleading;

• copy, modify, distribute, sell, sublicense, reverse engineer, probe, or attempt to extract source code from the App, except where applicable law expressly permits it;

• bypass security controls, interfere with the App, introduce malicious code, or attempt unauthorized access to accounts, systems, or data;

• use the App or study content for commercial, unlawful, or non-study purposes; or

• record, redistribute, or publicly post study content when study instructions prohibit doing so.

 

6. Study activities and participant safety

The App may assign or present music-listening sessions, questionnaires, reminders, and study instructions. Follow the informed consent form and instructions from the study team. Do not use the App while driving, operating machinery, or in any situation where listening or interacting with a device would be unsafe.

The App does not provide diagnosis, medical advice, treatment, counseling, crisis services, or emergency monitoring. It is not designed to detect or respond to a medical or behavioral-health emergency. If you may harm yourself or someone else, or have another emergency, contact local emergency services immediately. In the United States or Canada, you may call or text 988 where the service is available; availability and services vary by location.

 

Contact the study team using the information in the informed consent form for study-related questions, adverse experiences, technical problems affecting participation, or concerns about the music-listening activities.

 

7. Privacy and research data

Our collection and handling of personal information through the App are described in the App Privacy Policy and the informed consent form. Research analyses and reports are expected to use aggregated and/or de-identified information, but information associated with your account is identifiable or coded during study operations. Do not assume that information is anonymous merely because your name is not displayed.

 

8. Withdrawal, account closure, and retained study data

You may withdraw from the study as described in the informed consent form. After withdrawal, the study team will stop collecting new study data from you through the App, apart from limited information needed to process the withdrawal, protect security, meet legal obligations, or document study status. Data collected before withdrawal may continue to be retained and used to protect the integrity of the research and satisfy scientific, regulatory, ethical, and legal obligations. Data already de-identified or included in analyses generally cannot be located and removed.

Closing an App account is not necessarily the same as withdrawing from the study, and deleting the App from a device does neither. Contact the study team to withdraw or request account closure.

 

9. App ownership and study content

BeatSUD and its licensors retain all rights in the App, its design, software, text, graphics, study materials, and other content, except for information you submit. Music and other third-party content may be subject to separate rights and restrictions. No ownership rights are transferred to you.

 

10. Third-party services

The App may depend on app stores, mobile carriers, SMS/OTP providers, cloud hosting, music-delivery services, device operating systems, and research sites that BeatSUD does not fully control. Their terms and privacy practices may also apply. BeatSUD is not responsible for a third party's independent services, but will select and oversee research service providers as required by applicable agreements, the protocol, and law.

 

11. Availability, updates, and suspension

We may update, maintain, suspend, or discontinue App functions when reasonably necessary for security, safety, study operations, legal compliance, or technical reasons. We do not promise uninterrupted or error-free availability. We will use reasonable efforts to avoid unnecessary disruption and will provide study-related notice when appropriate.

 

12. Disclaimers

To the extent permitted by law, the App is provided for research use on an "as available" basis. BeatSUD does not promise that the App will meet every device configuration or that every message or session will be delivered without interruption. These disclaimers do not limit responsibilities stated in the informed consent form, obligations imposed by an IRB or ethics committee, or rights that cannot legally be excluded.

13. Limitation of liability

To the extent permitted by applicable law, BeatSUD will not be liable under these Terms for indirect, incidental, special, consequential, or punitive damages arising solely from use or inability to use the App. This section does not exclude liability for gross negligence, willful misconduct, breach of confidentiality or privacy obligations, research injury where applicable, or any liability that cannot legally be limited. The informed consent form controls any study-specific description of compensation or treatment for research-related injury.

 

14. Governing law and local rights

These Terms are governed by the laws of North Carolina, USA, without regard to conflict-of-law rules, except that mandatory protections of the place where you reside may still apply. These Terms do not require arbitration or waive a right to a jury trial unless BeatSUD later adopts a separately reviewed and lawfully presented dispute provision.

 

15. Changes to these Terms

We may update these Terms when the App, study, or legal requirements change. Material research-related changes will be handled through the IRB or ethics process when required. We will provide notice in the App or by another appropriate method and will request renewed agreement when required. The effective date identifies the current version.
